In the December 2025 issue of the LexisNexis journal Energie - Environnement - Infrastructures, read Camille Billmann and Alexandra Rochard’s commentary on the Council of State’s decision of September 30, 2025 (no. 492.891). In this welcome ruling, the Council of State 1/ clarifies that a judge cannot rely solely on the view from a historic monument to conclude ipso facto that it is being impacted; 2/ establishes well-defined criteria that reflect a balance between the imperative of heritage protection and wind energy development goals.
